Captain America was put out on Nostalgia Merchant tapes from a pretty decent copy of the film,prior to 1985. I used to have a Beta Max copy. Nostalgia Merchant morphed into Republic Pictures Video somewhat later, I believe. The film more than likely is in the public domain based on the fact it is over 64 years old. Copyrights extend 28 years and renewable for 28 more under the old law. Republic Pictures is defunct for 50 years, rights are scattered to their negatives and prints. However, since "Captain America" may be the property of the comic book company which authorized the original rights to Republic, or it's successors may retain the copyright as it's property. That makes it a very grey area.

Yeah, I took that into consideration too, but if I remember right, I believe there's some Superman cartoons from the 40's that are PD, some of which are here in the archive, and I think the same situation may apply here. I just want to be sure. If Video Cellar cares to throw his two cents in, I'd appreciate it.

Looking forward to it if it's determined to be in the PD. I used to have the tapes in question (EP), but they disappeared somehow.

I'd put it up if I had no doubt in my mind it was ok, but I wouldn't want to subject IA to the wrath of Marvel. They might sic the Hulk on 'em!
